Wills, Estates, Probate

At the Law Office of Richard J. Kaufman, we understand that one of the fundamental functions of counseling our client is the ability to provide a strategy to protect their assets and help them fulfill their intentions. We pride ourselves in assisting our clients in deciding on how to provide for the legal means to pass on their estate whether by preparing a last will and testament, a living trust or, as is often the case, by sometimes simpler and even less expensive alternatives. We also emphasize to our clients the importance of different alternatives available to address both asset and health control issues such as having a living will, a health care proxy and a power of attorney. It cannot be emphasized enough that because of the nature of the documents themselves, they must be done right the first time since it is too late to change them once they are actually needed.

Preparing the documents properly is only part of the services necessary to make sure your wishes are carried out. Our office has practiced in the Surrogate’s Court of most of the counties in the New York metropolitan area and resolved other estate issues in various jurisdictions around the country. Whether it is a matter of probating a will, or filing an estate petition where the deceased has not left a will (intestacy), or litigating complicated heirship issues or the contest of a will, our staff has successfully resolved these issues over the past 18 years.

Worker’s Compensation and Social Security Disability

Getting hurt on the job presents its own unique problems in order to obtain proper compensation. To prevent instability in the workplace, the state does not generally allow an employee to sue his/her employer or a fellow employee. That does not mean that there may not be other avenues to obtain full compensation as when, for instance, the premises or vehicle which caused the injury was not owned by the employer, or where the employer did not carry worker’s compensation insurance. There are also instances where, although the matter is otherwise processed through the Worker’s Compensation Board, an attorney may be helpful in obtaining full compensation by presenting a case in the light most favorable to the claimant.

Similarly, almost everyone has a story these days about social security disability claims becoming more and more difficult to resolve successfully, especially during the first stages of the application.

Our office is affiliated with one of the leading worker’s compensation on Long Island, Grey and Grey, LLC of Farmingdale, New York, which maintains a local branch at our Port Jefferson office. Because of the special and complicated nature of worker’s compensation and social security disability practice, we rely on these extremely able attorneys to assist and prosecute these matters knowing that the best results possible will be obtained.

Matrimonial and Family Court matters

Of the areas of legal counseling, none is more sensitive or necessary to complete representation of a client than that involving family and divorce issues. For that reason, our office provides a local branch affiliation with the Law Offices of James J. O’Rourke and Associates, PLLC, of Hauppauge, New York, one of the leading matrimonial practitioner firms in Suffolk and Nassau counties. These professionals specialize in contested and complicated matrimonial, custody, support and all domestic relations matters including prenuptial and separation agreements, and maintain a team of professionals including forensic accountants, psychologists and pension appraisers in order to obtain justice for their clients.

Other matters

Our firm has been involved in forming and advising corporations on Long Island since its inception in 1988 and regularly handles commercial matters ranging from the purchase and sale of businesses to consulting with companies and other law firms on complicated commercial issues. Our practice also includes landlord/tenant matters, both commercial and residential.

Because of the depth and breadth of experience of our attorneys and our staff, our clients will consult with us other matters outside of our usual expertise. In such instances, while we are more than glad to consult with you, usually without cost, to help provide some direction, we will never hesitate to advise when other counsel should be consulted. Remember, sometimes the best advice is to know when not to give advice.
